Standing with legitimate, compliant Malaysian contractors against illegal and unregistered construction operators.

Malaysian contractors invest heavily in CIDB registration, licences, worker permits, safety requirements, insurance, training, taxes and regulatory compliance.

They should not be forced to compete against illegal operators who avoid these responsibilities, reduce prices unfairly and take away opportunities from legitimate local contractors.

MSCA is committed to protecting Malaysian-owned contractors and supporting a lawful, responsible and professionally regulated construction industry.

Reporting Illegal Construction Activities

MSCA encourages members and industry participants to provide credible information involving suspected:

Unregistered or unlicensed contractors
Foreign individuals operating independently as contractors without lawful approval
Contractors using expired, borrowed or misused CIDB registrations
Local companies acting as fronts for unauthorised operators
Illegal deployment or supply of foreign workers
Foreign workers carrying out work outside the conditions of their permits
Undeclared construction projects or unauthorised subcontracting
Unsafe and non-compliant construction activities
False company documents, licences or worker records

All contractors operating in Malaysia, whether local or foreign, must comply with CIDB registration requirements. Foreign construction personnel must also hold valid immigration permission and the required construction-personnel registration.

Working With The Relevant Authorities

Where credible information and sufficient supporting evidence are received, MSCA may review the matter and refer it to the appropriate authorities, including:

Construction Industry Development Board Malaysia — CIDB
Immigration Department of Malaysia
Department of Labour
Local authorities
Occupational safety and health authorities
Police or other relevant enforcement agencies, where appropriate

MSCA may also liaise with the relevant agency to provide available information and support appropriate investigation or enforcement action.

MSCA itself is not an enforcement agency. Our role is to receive information responsibly, conduct an initial administrative review and direct credible cases to the authority legally empowered to investigate and act.

Protecting Local Opportunities

Foreign workers with valid permits may be lawfully employed by approved employers. Properly registered foreign contractors may also operate subject to Malaysian laws and CIDB requirements.

Foreign workers holding valid permits employed by approved employers, and properly registered foreign contractors operating in full compliance with Malaysian law and CIDB requirements.

Our Action Is Directed Against Those Who:

Operate without proper registration or approval
Avoid taxes, levies, permits and statutory responsibilities
Misuse Malaysian companies or licences as fronts
Employ or deploy workers illegally
Compete unfairly with compliant Malaysian contractors
Place workers, clients and the public at risk

MSCA supports lawful investment, legitimate expertise and properly authorised participation. At the same time, Malaysian contractors must receive fair opportunities and must not lose their livelihoods to illegal and non-compliant operators.

Responsible Reporting

Reports must be made in good faith and should include, where available:

Name of the company or individuals involved
Exact project or construction-site location
Description of the suspected activity
Dates and times
Photographs or videos taken lawfully
Vehicle, machinery or company details
Copies of relevant advertisements, quotations or documents
Any other information that may assist verification

MSCA will not act on rumours, racial allegations, personal revenge or unsupported accusations. Information will be reviewed responsibly before any referral is made. The final decision to investigate, prosecute or take enforcement action remains entirely with the relevant government authority.
